Casey's Competency Dear Judge Eaton: Why would the defense wait until this late in the trial to claim that Casey Anthony may not be competent to stand trial? Dear Judge Eaton: Since there are several counts, can the jury be hung on the first-degree murder and then guilty on another of does it end if they are hung on the first charge? -- Elise The jury will have four choices on the murder charge: first-degree murder, second-degree murder, aggravated manslaughter and manslaughter. If the jury cannot agree on any of these, a mistrial will be declared as to that count. The jury can convict on other charges, find the defendant not guilty or be unable to come to a decision. -- Judge O.H. Eaton Sunshine Law & Sealed Documents Dear Judge Eaton: With Florida having the Sunshine Law, I was wondering the criteria for getting something sealed like Judge Perry did Saturday? -- Brenda The Sunshine Law has to do with public bodies such as county commissions, city councils or school boards. These bodies are not allowed to make decisions except during a duly noticed public meeting. It does not apply to the legislative or the judicial branch. However, the judicial branch has been operating in the public for hundreds of years. Court records are generally public records. However, sensitive documents such as mental examination results can be sealed, which means they cannot be viewed by the public without a court order. -- Judge O.H.
