Feds could sue state over secret unions voting
The constitutional amendment by Rep. Kurt Wallace, R-Maplesville, that was approved by the Legislature in the 2011 regular session will be on the 2012 general election ballot.
If voters approve the amendment, the National Labor Relations Board could sue to stop enforcement if it determines the amendment is similar to an Arizona secret ballot amendment the NLRB already is challenging in the courts.
Wallace said he believes his constitutional amendment will survive a challenge, but figures there will be a lawsuit anyway. “We’re just going to see how it does,” he said Thursday.
Al Henley, secretary-treasurer of the Alabama AFL-CIO, said of the amendment, “We were completely unconcerned about it because the NLRB said it will sue any state that does that. Obviously it’s going to be thrown out in federal court.”
Henley said the amendment is similar to other measures passed by the Republican-controlled Legislature that probably will cost the state millions in legal fees to defend. “Obviously this is a payback to the legal community that supported them,” he said.
Secret ballot efforts began in 2009 after introduction of a pro-union bill in Congress backed by President Barack Obama. The legislation, co-sponsored by then-U.S. Rep. Artur Davis, D-Ala., would allow unions to organize even small businesses.
According to the bill, if more than 50 percent of the workers in businesses of 10 or more employees sign union representation cards, the NLRB “shall not direct an election,” but will certify the labor organization.
Currently an employer has the right to challenge a card-check with a secret vote overseen by the NLRB.
The operational language of Alabama’s proposed amendment says where state or federal law requires elections “or designations or authorizations of employee representation, the right of individuals to vote by secret ballot shall be guaranteed.”
The words “designations” and “authorizations” could be the problem if the NLRB believes the words conflict with federal law.
Lafe E. Solomon, acting general counsel of the NLRB, in January told Arizona Attorney General Tom House that federal law describes two ways to choose union representation.
One is a board-supervised secret ballot vote and the other is the card-check method in which a company agrees to union representation if employees sign union cards.
